The former National Security Adviser to former President Goodluck Jonathan, retired Colonel Sambo Dasuki has told a High Court sitting in Abuja that President Muhammadu Buhari was responsible for his arrest and detention without trial since December 29, 2015.
Dasuki is currently being prosecuted by the Economic and Financial Crimes Commission (EFCC) over allegations of mismanagement of funds for the purchase of arms for the Armed Forces.
In an affidavit filed by his council, Joseph Daudu, in support an application, Dasuki said the President unjustly instigated his arrest and detention by the operatives of Department of State Security (DSS) against the bail granted him by three different courts in various criminal charges brought against him by EFCC.
The former NSA said the President betrayed his emotion during the presidential media chat when he openly told Nigerians that he and Nnamdi Kanu would not be allowed on bail because they would jump bail.
He said has been held incommunicado since his re-arrest on December 29 despite meeting bail conditions at three different courts because of the presidential body language.
He, therefore, asked Justice Affen to prohibit his further trial until the federal government allows him to enjoy the bail granted him by the courts which would him to prepare effective defence in the various criminal charges brought against him by the government.
Opposing the application, counsel to the federal government, Mr Rotimi Jacob told the court that the charges against the former NSA was at the instance of the EFCC and not the DSS, adding that when the bail conditions were perfected, Dasuki was released by the prison authority at Kuje, but was rearrested by another agency of government.
After listening to the arguments of the two counsels, Justice Peter Affen fixed March 4, 2016 for ruling on the application.
